1. Heard Sri Ashish Kumar, learned counsel for applicant and learned A.G.A. for State.
2. The present bail application has been moved by accused- applicant for enlarging him on bail in Case Crime No. 286 of 2016, under Sections 498-A, 304-B and Section 3/4 Dowry Prohibition Act, Police Station Kotwali, District Maharajganj.
3. It is stated that applicant is innocent and has falsely been implicated in the present case. He is in jail since 11.6.2016.
4. The applicant is husband. Marriage was solemnized on 11.8.2014 and after more than 2 years the incident has taken place wherein wife of applicant has died at the residence of applicant. As per post mortem report, death is caused due to strangulation. FIR has been lodged by father of deceased and not by applicant. It was the responsibility of applicant for safety and care of his wife.
5. Looking to entire facts and circumstances, at this stage, I do not find it a fit case for grant of bail.
6. Application is accordingly rejected.
