Smt. Alpana, petitioner-1 appears before the Court and claims to be major. In support thereof, she filed her Aadhar Card in which her date of birth has shows as 16.9.1999.
Smt. Alpana, petitioner-1 states that she has voluntarily married to Rohit Kumar, petitioner-2 and their marriage has also been registered with Marriage Registration Officer on 3.1.2019, therefore, no useful purpose will be served in arresting the petitioners.
In the facts of the case, the writ petition is disposed of with direction that petitioners shall not be arrested in pursuance of FIR dated 21.11.2018, registered as Case Crime No. 2585 of 2018, under Section 366 IPC, P.S. Kavi Nagar, Distt. Ghaziabad, till submission of police report under Section 173 (2) Cr P C.
