Heard counsel for the petitioner and learned standing counsel for the respondents.
This writ petition has been filed seeking amongst other the following reliefs:
Issue a writ of mandamus directing respondent no. 1, Consolidation Officer, Sehson, Tehsil Phulpur, distrit Allahabad to decide the Restoration Application filed by the petitioners in case no. 31/2010-11, instituted under section 20(1) of UP Consolidation of Holdings Act, 1953, Harilal and others Vs. State of UP and others, expeditiously.
It has been stated by the counsel for the petitioner that a restoration application is pending since the year 2010.
Under the circumstances, the writ petition is dispose of with a direction to the Consolidation Officer, Allahabad (Respondent no. 1) to decide the restoration application filed by the petitioner expeditiously preferably within a period of two months from the date of production of certified copy of this order before him/her. Needless to say that the order shall be passed by respondent no. 1 in accordance with law after hearing the concerned parties. It is further provided that the Consolidation Officer may dispose of the application aforementioned without granting any unnecessary adjournments to any of the parties.
