Petitioner's father was appointed in District Cooperative Bank Meerut on 14.5.2016. He is stated to have died on 10.6.2017. An application moved by the petitioner, who is the son of the deceased employee, for grant of compassionate appointment has been rejected on 21.9.2020. This order records that by virtue of Regulation-104 of 'The U.P. Cooperative Societies Employees' Service Regulations, 1975', a period of three years continuous service must be put in by the employee before he become entitled for compassionate appointment. This order is assailed on various grounds.
Sri Nikhil Kumar appearing for the respondent has placed before the Court Regulation-104 which clearly provides that recruitment of employees in dying in harness would be dependent upon deceased employee holding his post for a minimum continuous period of three years. Since such minimum period of working was not completed by the petitioner's father as such rejection of claim for compassionate appointment cannot be said to be arbitrary or contrary to rule.
Writ petition lacks merit and is accordingly dismissed.
