Heard learned counsel for the applicants and learned AGA for the State.
By means of the present application, the applicant has prayed to quash the prosecution of complaint case no. 330 of 2013, under Sections 494, 120B, 504 and 506 IPC pending before A.C.J.M.,Agra.
Learned counsel for the applicant submitted that the present proceeding of case no. 330 of 2013, Smt. Sarita Arora Vs. Alok Chhabra and others was rejected by the court of ACJM, Court No.8, Agra on 20.01.2017.
The said order is annexed as SA-1 in the supplementary affidavit. Sri Ashok Kumar Gupta, learned counsel for the applicant submitted that the aforesaid proceeding was dismissed in exercise of power under Section 256 Cr.P.C. and that order has not been challenged before any other forum and the order has attained finality. Accordingly, the present 482 Cr.P.C. application has rendered infructuous and is accordingly dismissed.
