Heard Sri Tarun Agrawal, learned counsel for the petitioners.
The petitioners have applied for correction of my order dated 30.5.2016 by which the writ petition was disposed of.
The controversy in the writ petition was whether the orders dated 17.3.2016 and 18.3.2016 were passed by the U.P. Pollution Control Board were without notice or affording opportunity of hearing to the petitioners. It was held that the orders were passed in violation of the principles of natural justice and therefore an order of remand was passed. However, in remanding the matter the appellate authority was directed to pass fresh orders in place of U.P. Pollution Control Board.
The error is apparent on the face of the record. Accordingly, order dated 30.5.2016 is corrected as follows:-
In the fifth and sixth lines of the seventh paragraph and in the fourth line of the last paragraph the word "Appellate Authority" be deleted and substituted by Pollution Control Board.
Correction Application No. 186760 of 2016 is allowed.
