ORDER:
This appeal is filed against order, dated 08.08.2012, in I.A.No.1898 of 2011 in I.A.No.696 of 2010 in O.S.No.264 of 1999 on the file of the learned Principal Senior Civil Judge, Kakinada, whereby it has determined mesne profits for the period from the second crop of 2005 to the first crop of 2010.
M/s Bharadwaj Associates, learned counsel for the appellant, has addressed letter, dated 02.09.2014, to the Registrar (Judicial), wherein it is stated that the matter was compromised between the parties before the lower Court; that in pursuance thereof, registered partition deed, dated 21.10.2013 was executed between the parties; and that in view of the same, the appellant intends to withdraw the appeal.
In the light of the above letter, the appeal is dismissed as withdrawn.
As a sequel to dismissal of the appeal, ASMP.No.2669 of 2011 is dismissed as infructuous.
