Heard Sri Gaurav Kakkar, learned Advocate, who appeared to press the bail application moved on behalf of Allo @ Alauddin, Bali Mohammad @ Chacha, Sanju, Ali Mohammad @ Alimuddin and Rizwan @ Rajjo, who are appellants in Criminal Appeal No.395 of 2010 and the learned Additional Government Advocate.
Appellants, above named, were prosecuted for the offence punishable under section 411 I.P.C. and the sentence is for 3 years so mentioned in the judgment and they have to serve out the sentence so provided. Appeal is to be heard.

Record of the lower court be summoned at the earliest. In view of the short sentence and on the facts and circumstances of the case, this Court is of the view that the appellants be enlarged on bail in S.T. No.1128 of 2008 be enlarged on bail on their furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned. Realization of fine, if any in respect to above appellants to the extent of fifty percent shall remain stayed. Balance amount of fine shall be deposited forthwith. The release order shall be sent after deposit of fine.
