ORDER:
This Civil Revision Petition is filed aggrieved by the order dated 4.4.2013 passed in I.A.No. 787 of 2013 in A.S.No. 115 of 2013 by the learned II Additional Chief Judge, City Civil Court, Hyderabad, whereby operation of the decree dated 29.10.2012 passed in O.S.No. 1044 of 2010 was stayed until further orders, subject to the condition of the petitioner paying suit costs to the respondent and depositing 50% of the decreetal amount to the credit of the suit within a time frame.
This Court while ordering notice before admission on 11.10.2013, granted interim stay of all further proceedings in E.P. No.140 of 2013 on the file of the Senior Civil Judge, City Civil Court, Hyderabad, subject to the condition of the petitioner depositing 25% of the decreetal amount to the credit of EP on or before 31.10.2013. Now, it is submitted by the learned Counsel for the petitioner that the petitioner has complied with the aforesaid order.
A short prayer now made by the learned Counsel for the petitioner is that the trial Court may be directed to dispose of the appeal at an early date.
Having heard the learned Counsel on either side and gone through the material on record, the lower Court is directed to consider and dispose of A.S.No. 115 of 2013, on merits and in accordance with law, expeditiously, preferably within a period of six months from the date of receipt of a copy of this order. The respondent is permitted to withdraw the amount deposited by the petitioner pursuant to the order of this Court dated 11.10.2013.
The CRP is disposed of accordingly. The miscellaneous petitions pending consideration if any shall stand closed. No order as to costs.
