1. An application for urgency has been filed stating that technical bid of petitioner has been rejected and financial bid is likely to be finalised on any day, hence, accepting this urgency application, we have taken up this matter today.
2. Shri D.S. Shukla, learned counsel, who has put in appearance on behalf of Indian Oil Corporation, at the outset, stated that financial bid has already been finalised on 26.12.2019, therefore, the substantive relief no. 2 sought in the present writ petition has rendered infructuous as on today.
3. At this stage, Shri Swapnil Kumar, learned counsel for petitioner stated that in view of subsequent event, he may be permitted to withdraw this writ petition with liberty to file a fresh one, with appropriate pleadings and material, as the case may be.
4. Shri Shukla, learned counsel appearing for Indian Oil Corporation, has no objection to aforesaid request.
5. Writ petition is accordingly dismissed with aforesaid liberty.
