Heard Sri S.B. Singh, learned counsel for the petitioner- bank states that an application was filed praying for declaring the writ petition to have become infructuous as the respondents have already cleared the entire outstanding amount of the petitioner-bank with regard to which a suit had been filed by the bank.
The petitioner-bank had filed this writ petition for a direction to the learned Court below to decide Original Suit No. 144 of 2003. It is stated that the withdrawal application was filed in the Court and orders were passed on 16th January, 2018 to list the said application with previous papers. A copy of the said application has been produced by the learned counsel for the petitioner. The original application is not on record.
The office is directed to trace it out and place it on record.
In view of the prayer made and having heard Sri S.B. Singh, this writ petition is consigned to records as infructuous. This order shall also govern the application of withdrawal.
