HONOURABLE SRI JUSTICE S.RAVI KUMAR CIVIL REVISION PETITION No.3753 OF 2003 ORDER:
This revision is against orders dated 27-6-2003 in I.A.No.318 of 2003 in H.M.O.P.No.68 of 2002 on the file of Additional Senior Civil Judge, Tenali.
Revision petitioner herein is the husband who filed H.M.O.P.No.68 of 2002 for dissolution of marriage whereunder wife filed I.A.No.318 of 2003 claiming Rs.5,000/- per month as interim maintenance and Rs.5,000/- towards legal expenses and the learned trial judge after considering contentions of both parties ordered payment of Rs.1,000/- per month to the wife and Rs.500/- each to the minor children as interim maintenance, besides a sum of Rs.2,000/- as legal expenses.
Now challenging the same, husband preferred present revision.
Heard advocate for petitioner.
The main grievance of the revision petitioner is that trial court without any material granted interim maintenance to the wife and children and that they are not entitled both for maintenance and legal expenses. It is further contended that the revision petitioner is an unemployee and staying with his brother and parental family and he is dependent on them and therefore, granting maintenance is not correct.
I have perused the material papers filed along with revision and also the impugned order dated 27-6-2003.
There is no dispute with regard to relationship between the parties.
As seen from the material, as on the date of filing of this I.A., two minor children were prosecuting their studies of IV class and U.K.G. and they are studying in J.K.M. Public School, Kukatpally, Hyderabad. The revision petitioner filed H.M.O.P. for dissolution of marriage and by invoking provision of Section 24 of Hindu Marriage Act wife filed I.A. seeking interim maintenance besides legal expenses. Though she claimed a sum of Rs.5,000/- per month, the trial court granted only Rs.2,000/-, in total, for the wife and children as interim maintenance.
It is represented that H.M.O.P. is dismissed and challenging the same, husband preferred C.M.A. and same is now pending.
Considering the facts and circumstances of the case and relationship between the parties, I do not find any illegality in the order of the trial court and there are no merits in the revision.
Accordingly, this Civil Revision Petition is dismissed.
As a sequel to the disposal of this revision, the Miscellaneous Petitions, if any, pending, shall stand dismissed.
