Ali vs Station House Officer

High Court Of Kerala|23 May, 2014
|

JUDGMENT / ORDER

Petitioner is the first accused in Crime No.174 of 2014 of the Areacode Police Station for the offences punishable under Secs.283 and 353 r/w Sec.34 of the Indian Penal Code, apprehends arrest and has filed this application.
2. Learned Public Prosecutor has opposed the application.
It is submitted that on 01.03.2014 at about 6p.m, while the police party was on patrol duty and came to the scene of occurrence, they were obstructed by the petitioner and others using a motor cycle. The attempt was to prevent the police party apprehend persons engaged in illegal mining and removal of river sand.
3. Learned counsel submits that the allegations are not true.
4. Having regard to the nature of allegations, I am inclined to think that this is not a fit case for the grant of anticipatory bail. In case the petitioner is arrested, after interrogation/identification if any are over, he shall be produced before the jurisdictional magistrate as early as possible, where it is open to the petitioner to request for bail.
The application is disposed of as above.
