Heard Sri Sanjay Srivastava, holding brief of Sri A.K. Srivastava, learned counsel for the petitioner and Sri Jitendra Singh, learned AGA for the State.
Learned AGA pointed out that it is a case of no injury but there is no averment made in the present petition regarding the same to which learned counsel for the petitioner states that the present petition be dismissed as not pressed with liberty to file fresh petition mentioning the said averment. The present writ petition is, accordingly, dismissed as not pressed with liberty to file fresh petition.
Office is directed to return the certified copy of the FIR to the learned counsel for the petitioners after retaining a photocopy of the same.
