Heard learned Counsel for the petitioners, Sri Rama Nand Pandey, learned Additional Chief Standing Counsel for the State- respondents and Sri M. C. Chaturvedi, learned Senior Advocate assisted by Sri Suresh Chandra Dwivedi, learned Counsel representing respondent No.5.
This petition has been filed by the residents of Nehru Park (Aarya Nagar), Ward No.49, Loni, Ghaziabad apprehending that an area of 10,000 sq. yard reserved for park is likely to be developed, plotted and sold out for construction by the respondent No.7 in collusion with the State Authorities and the Local Bodies. At present, we do not find any construction is going on or that sale deeds have been executed.
We are therefore not inclined to entertain this petition at this stage. However, it will be open to the petitioners to raise their grievances before the Collector, Ghaziabad, Ghaziabad Development Authority and the Nagar Palika Parishad, Loni, District Ghaziabad and the State Authorities, who, after due verification, would take an appropriate decision on the representation of the petitioner within six weeks from the date of its presentation alongwith a certified copy of this order.
Petition is dismissed accordingly.
