Heard the learned counsel for the petitioners, learned A.G.A. and perused the record.
Learned counsel for the petitioners has submitted that it is a matrimonial dispute and there are chances of amicable settlement between the parties and hence, it is expedient in the interest of justice that the matter may be referred to Mediation and Reconciliation Centre for consideration.
Learned A.G.A. has no objection to it.
The petitioners are directed to deposit a sum of Rs. 10,000/- in the Mediation and Reconciliation Centre. Out of the said amount, a sum of Rs. 7000/- shall be paid to the opposite party no. 2, Smt. Hina Kazmi and the remaining amount of Rs. 3000/- would be utilized for expenses. The said amount shall be deposited within a period of two weeks from today and the petitioners shall file an affidavit mentioning the fact of the deposit of the amount in the court.
Registry is directed to issue notice to the opposite party no. 2 returnable at an early date and a date shall be fixed for appearance of the parties in the Mediation and Reconciliation Centre.
The Mediation and Reconciliation Centre shall submit its report within a period of two months.
Till the next date of listing, the operation/implementation of the impugned order dated 03.082010 passed in complaint case no. 929 of 2010, under sections 498-A, 506 I.P.C. & 3/4 Dowry Prohibition Act, pending in court of learned Special Additional Chief judicial Magistrate, CBI (Ayodhya Prakaran), Lucknow shall remain stayed.
In case of default by the petitioners, this interim order shall be deemed to have vacated automatically Order Date :- 27.10.2010 kkm
