JUDGMENT / ORDER

Petitioner is the holder of arms license. The application for renewal has been rejected by the Additional District Magistrate. Petitioner preferred an appeal. In appeal, the order of rejection was set aside and remanded back for reconsideration. After the remand, District Magistrate affirmed the original order and rejected the renewal application. It is challenging these orders, this writ petition is filed. The only reason referred in the impugned order is that there is no threat to the life of the petitioner. Petitioner is a responsible bank manager and has no adverse recommendation or report against him by the police authorities.
3. Learned counsel for the petitioner submits that rejection can only be with reference to the grounds referred in Sec.14 of the Arms Act. None of the grounds has been canvassed for rejecting the renewal. This Court held in the decision in Muhammed Shafi Vs. District Collector (2012(1) KLT 427) that rejection can only be with reference to the grounds referred n Sec.14 of the Arms Act.
W.P(C).No.32769 of 2014U 2 3. Having regard to the facts and circumstances, the impugned order is unsustainable. Accordingly the above order is set aside. However, there shall be a direction to the first respondent to renew the arms license of the petitioner within a period of four weeks from the date of receipt of a copy of this judgment.
The writ petition is disposed of as above. No costs.
