Petitioner had filed Ext.P4 complaint before respondents 2 and 3 with respect to the transaction he had with respondents 4 and 5. Petitioner is said to have some transaction with the fifth respondent on which certain monetary disputes were raised. Petitioner seeks for an enquiry by the Registrar of Co-operative Societies, the second respondent. In fact, under Section 69(h) of the KCS Act, 1969, monetary disputes are to be taken up before the Arbitrator constituted for considering the same, having jurisdiction over the area of operation of the Society.
In such circumstance, reserving the liberty of the petitioner to approach the Arbitrator under Section 69 of the KCS Act, the writ petition stands closed. However, the period between 3.11.2010 till today would not be taken to compute limitation, if at all prescribed, under the KCS Act.
