Heard learned counsels for the parties.
By means of present petition, the petitioner has questioned the correctness of the order of Deputy Registrar, Meerut dated 29.05.2019, whereby, he has proceeded to hold the elections under Section 25(2) of the Societies Registration Act, 1860 with the publication of the election schedule.
The petitioner is basically aggrieved against the order on the ground that the resolution of the executive body dated 29.05.2018 has been annulled by the Deputy Registrar under the order impugned.
Sri R.K. Ojha, learned Senior Advocate assisted by Sri Nipun Singh, learned Advocate has placed before this Court the election schedule already published on 25.07.2019 under the order dated 07.06.2019 impugned herein this petition and also the list of contesting parties who have filed their nominations pursuant to the said election schedule, which includes the name of petitioner Mukesh Gupta as well.
On a pointed query being made to the learned Senior Advocate Sri P.K. Jain, assisted by Sri Abu Bakht, learned counsel for the petitioners, as to whether these papers can be disputed, Sri Jain could not dispute the same.
In such facts and circumstances, and the fact that the election proceedings are already underway, this Court considers it appropriate not to interfere with the same. Let the election proceedings come to their logical end and will be open to challenge before appropriate forum.
However, dismissal of this writ petition on the above count will not reflect on the validity of the elections, if any held.
Writ petition is consigned to record.
