Heard learned counsel for the petitioner.
By means of this writ petition under Article 227 of the Constitution, the petitioner has prayed for following relief:-
"(i) to direct the court of Civil Judge (S.D.) to decide the original suit no. 82 of 2018 (Smt. Nafisha V. Alekh Raj Saini and others), pending before the court of Civil Judge (S.D.) Jhansi within stipulated period fix by this Hon'ble Court (Annexure No. 1 to the petition)."
The suit is of the year, 2018. The evidence of the parties has not yet been completed. This is widely known fact that Covid is prevailing in the country and the state for the last one year and the judicial work of the courts below are also affected.
In such circumstances, no direction can be issued fixing time bound period for disposal of the suit, however, it is expected that the court will not grant unnecessary adjournment to either of the parties and shall endeavour to conclude the said proceeding as expeditiously as possible.
The petition is disposed of with the aforesaid observations and directions.
