JUDGMENT / ORDER

The limited prayer in this original petition is for a direction to the Sub Court, Manjeri to take up and dispose of the final decree application said to have been filed as early as in 2012.
2. The petitioner is the plaintiff in O.S.No. 1/2010 which is a suit for partition. In the suit, preliminary decree was passed and in pursuance to preliminary decree, a final decree application was filed by the plaintiff. Commissioner was deputed and the Commissioner has filed a report. The petitioner says that objections have been filed to the Commissioners report seeking to have it set aside, but even after several postings, nothing has been done and the matter is pending before the Sub Court, Manjeri. The petitioner points out that irreparable injury is to be caused to him by the delay in disposing of the application.

3. In the light of the order that is proposed to be passed, it is felt that notice to the respondent is unnecessary.
There will be a direction to the Sub Court, Manjeri to take up final decree application in O.S.No. 01/2010 as early as possible and dispose it of as expeditiously as possible, at any rate, within a period of six months from the date of receipt of a copy of this judgment.
