Petition under Section 438 Cr.P.C. 2. Petitioner is the sole accused in Crime No.1057/2014 of Athirappilly police Station registered for the offences punishable under Sections 377 of the Indian Penal Code and Sections 4 and 8 of Protection of Children from Sexual Offences Act, 2012.
3. The allegation against the petitioner is that during April 2014, he has subjected a minor girl of 15 to carnal intercourse against the order of nature, thereby committing unnatural offence.
4. Heard the learned counsel for the petitioner and the learned Public Prosecutor. The contents of the C.D. Prima facie reveal the complicity of the petitioner. The allegations against the petitioner is very grave and serious. The investigation of this case B.A.7874 of 2014 2 is not over. Considering the seriousness of the allegations against the petitioner and the present stage of investigation, I am of the view that this is not a fit case wherein anticipatory bail can be granted to the petitioner.
In the result, this bail application is dismissed.
