Petitioner has approached this Court seeking release of his vehicle bearing Reg.No. KL-10AL-3676. Perusal of Ext.P1 indicates that the allegation of the Seizing Officer is that the vehicle was being used for filling up paddy land, which is in violation of the Kerala Conservation of Paddy Land and Wet Land Act, 2008 (hereinafter referred to as 'the Act'). 2. Learned counsel for the petitioner submits that there is no material to indicate that the said vehicle was used for such an act as stated in the mahazar.
3. Under such circumstances since the petitioner seeks for release of vehicle, this writ petition is disposed of as under:
First respondent shall consider the entire matter on a representation being filed by the petitioner and necessary interim orders shall be passed, on the petitioner furnishing security by way of immovable property to the extent of 1.5 times value of the vehicle involved in the matter. On furnishing security, the vehicle shall be released forthwith.
W.P.C.No.15996 OF 2014 2 Final orders shall be passed within a further period of six weeks.
