The petitioner is aggrieved with the rejection of the variation sought for by the petitioner.
2. The petitioner is operating a route Kottapalla - Anjilangadi - Kozhikode Medical College. The petitioner sought for curtailment of last route. In Ext.P2, R.T.A. Malappuram, found that curtailment would adversely affect the public traveling late in the night. The Tribunal has also looked into the matter and on facts found that the R.T.A. was right in rejecting the request for variation involving curtailment, in public interest. It may not be proper for this court to interfere with such findings made by the R.T.A., and confirmed by the State Transport Appellate Tribunal, unless there are compelling circumstances, which does not exit in the above case.
Writ Petition would stand dismissed.
