Sri Krishna Datta Tiwari, learned counsel for the petitioner and learned Standing Counsel for the State.
Counsel for the petitioner submits that respondent no. 3, Up Ziladhikari Tamkunhiraj, District Kushinagar be directed to decide the application of the petitioners ated 22.6.2019 in purusance of report dated 18.11.2019 submitted by the Naib Tehsildar, Tehsil Tamkunhiraj, Distdrict Kushinagar within a stipulated time.
This prayer is not opposed by the learned Standing counsel.
In view of such facts, the writ petition can be disposed of with a direction to respondent no. 3 to decide the aforesaid application of the petitioners on its own merits, if possible, within a period of 90 days from the date of receipt of computer generated copy of the order being passed today in PDF form strictly in accordance with law.
In above terms, the writ petition is disposed of.
It is made clear that this Court has not expressed any opinion on the merits of the case.
