Heard learned counsel for the petitioner as well as learned Standing Counsel on behalf respondents.
It has been submitted by petitioner that he is an adopted son of Late Pushpa Raj Singh, who was working on the post of Chairman in the Revenue Department at Tehsil Meja, District Allahabad. He has submitted that Pushpa Raj Singh died during his service period on 07.09.2017, leaving behind his old mother and five sisters. On the death of Pushpa Raj, the petitioner who claims to be an adopted son moved an application before the Chief Revenue Officer, Allahabad (respondent No.3) with the prayer for appointment under the provisions of dying in harness rules.
It has been submitted that respondents have not considered the representation made by the petitioner and no decision on the same has been communicated to him till date.
The counsel for the petitioner has drawn out attention of this Court to the application dated 23.11.2017 which has been annexed as Annexure No.9 to this writ petition. The petitioner further confines his relief for appropriate consideration on his application by the competent authority.
Learned Standing Counsel on the other hand also does not oppose the consideration of the application by the competent authority under the provisions of dying in harness rules in the present case.
In light of the above, the respondent No.2 is directed to decide the application dated 23.11.2017 as contained in annexure No.9 to the writ petition, expeditiously, say within a period of two months from the date of production of a certified copy of this order by a reasoned and speaking order in accordance with law and communicate the same to the petitioner.
With the aforesaid direction, the writ petition stands disposed of.
