HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.23282 of 2014 ORDER:
The petitioner avers that the second respondent in the writ petition borrowed term loan, which fell due long ago and by 04.06.2013, the loan amount accumulated to Rs.14,71,772/-. The petitioner is the guarantor on the loan obtained by the second respondent. Being a guarantor, as the responsibility also throws on him on account of the default committed by the original borrower, the petitioner was eager to know the loan account details and to this extent, a legal notice was issued on behalf of the petitioner, dated 11.07.2014, to the Branch Manager, State Bank of India, Jangareddygudem, West Godavari District (1st respondent). Alleging that no response is given to the notice issued on behalf of the petitioner to the 1st respondent regarding status of the loan account where he has a vital interest, this writ petition is instituted.
2. Learned Standing Counsel, on instructions, submits that the outstanding amount on the loan account now stand at Rs.15,53,341/- and the 1st respondent bank is willing to furnish the details as per the request made by the petitioner.
3. Having regard to the submissions made, the Writ Petition is disposed of directing the Branch Manager, State Bank of India, Jangareddygudem, West Godavari District (1st respondent) to consider the notice issued on behalf of the petitioner on 11.07.2014 and pass appropriate orders, as warranted by law, and if there is no impediment in furnishing the details of the loan account bearing A/c.No.31710186623, the details may be furnished to the petitioner as early as possible, preferably within a period of two (2) weeks from the date of receipt of a copy of this order. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
