Heard learned counsel for the petitioner.
By means of this petition under Article 227 of the Constitution, the petitioner has prayed for following relief:-
"a) Issue a writ, order or direction in the nature of mandamus directing the Civil Judge (Jr. Div.) Gorakhpur to decide the Case No.1269 of 2013 (Shakil Ahmad Vs. Alam Husain) expeditiously within short stipulated period."
It is contended that the case is at the stage of evidence.
In such above view of the matter, this petition is disposed of with direction that the court below shall conclude the evidence of the petitioner-plaintiff within the six months, the evidence of the defendant shall be concluded within the next six months and the proceedings of the suit thereafter shall be concluded thereafter within next six months from the date of production of copy of this order.
It is clarified that time frame provided for disposal of the case shall be deemed to be extended in the event concerned District is hit by another surge of pandemic (SARS COV-2/COVID 19) resulting in the suspension of public movement and/or judicial work in the District concerned.
