Heard learned counsel for the petitioner as well as learned AGA appearing for the State respondents and perused the record.
Present petition has been filed with a prayer to direct the respondents no. 1, 2 and 3 to transfer the investigation and assign the investigation of Case Crime No. 948 of 2021 under Sections 307, 504, 506 IPC, P.S. Chakeri, District Purvi (Commissionerate Kanpur Nagar) to some other investigating agency/authority.
Petitioner herein is father of the accused, who has come forward to this Court to transfer the investigation.
Learned AGA submits that in Case Crime No. 962 of 2020 under Sections 147, 148, 149, 302, 323, 504, 506, 34 IPC, a charge-sheet has already been filed.
After some arguments, learned counsel for the petitioner prayed that he may be permitted to withdraw the present petition.
Prayer aforesaid is allowed.
Present petition is accordingly dismissed as withdrawn.
However, it is made clear that no liberty is being granted to the petitioner to file a fresh petition for the same relief.
