JUDGMENT / ORDER

K. M. Joseph, J. The appeal is launched against the judgment of the learned Single Judge by which the writ petition filed by the appellant challenging Ext.P11 order passed by the Deputy Commissioner (Appeals), granting stay of collection of balance tax including penalty, interest and Cess for the years 2008-09, 2009-10, 2010- 11 & 2012-13 on condition of payment of 30% of the balance tax, penalty, interest and Cess demanded within two weeks and to furnish adequate security for the balance amount to the satisfaction of the assessing authority, was dismissed. The learned Single Judge did not find merit in interfering Ext.P11 order. However, two weeks time is granted to satisfy the requirement.
2. Heard the learned counsel for the appellant and the learned Government Pleader.
We do not think that the appellant has made out a case for interfering with the judgment of the learned Single Judge.
W.A. No.695/2014 2 In the circumstances, we dismiss the appeal. At the same time, we give one month time from today to the appellant to comply with the condition in Ext.P11.
