Heard Shri Anurag Pathak, learned counsel for the petitioners and Shri R.P. Tiwari, learned Standing Counsel for the respondents.
Present Writ Petition under Article 226 of the Constitution of India has been filed by the petitioners, who are 83 in numbers, for issuance of direction to the respondents to re-check/re-evaluate the answer sheets of Mathematics subject of Intermediate Examination for the year 2019 conducted by Madhyamic Shiksha Parishad, Uttar Pradesh in which they were awarded zero marks out of hundred and in English subject marks were very less and they have been declared failed.
This Court vide order dated 21.11.2019 directed learned Standing Counsel to seek instructions in the matter and produce the copies of Mathematics. On the instructions received by learned Standing Counsel, copies are produced before this Court, but since more than 500 students approached this Court, therefore, it is not possible to permit the learned counsel for the petitioners to check the copies.
Learned Standing Counsel has produced the letter dated 11.12.2019 in which the copies were re-checked by the subject expert and some of the students' marks were changed, but the marks of the remaining students remained unchanged.
Learned Standing Counsel submits that fresh mark sheet will be issued to the candidates, whose marks were changed after checking of the copies in question by the subject expert. Learned Standing Counsel further submits that it is not possible to permit the learned counsel for the petitioners to check the copies in the Court itself and for that purpose learned counsel for the petitioners should approach the Additional Secretary, Madhyamic Shiksha Parishad, Regional Office, Meerut within a week for fixing the date for checking the copies in question.
