Present Appeal from Order has been filed by the appellant-original plaintiff being aggrieved with the order passed below Exh.5 in Special Civil Suit No.464/2007 by the 6th Additional Sr. Civil Judge (SD), Ahmedabad dated 29.09.2012 on the grounds stated in the memo of appeal.
Heard learned counsel, Shri J.A. Adeshra for the appellant and learned counsel, Shri Saurabh Amit for the respondent no.16 on caveat.
After some arguments, learned counsel, Shri Adeshra seeks permission to withdraw the present Appeal from Order without prejudice to the rights and contentions with a liberty to make an application for expeditious hearing of the suit. Permission, as prayed for, is granted. Present Appeal from Order stands disposed of as withdrawn. As and when such an application is made to the trial court, an endeavour shall be made to expedite the hearing of the suit so as to dispose of it preferably within six months.
In view of above withdrawal, above Civil Application does not survive and stands disposed of accordingly.
