This petition is directed against an order dated 29.6.2018, whereby petitioner’s transfer from District Meerut to District Basti, made earlier on 22.5.2018, has been cancelled. It is submitted that the petitioner had joined pursuant to the order of transfer and there is no justification to cancel the transfer.
Learned Standing Counsel, on the basis of the instructions, submits that petitioner is resident of Ghazipur and had remained posted at Basti from 2005 till 2017. He has worked at Meerut only for a year, where after, he has been transferred again to Basti. Submission is that once it was brought to the notice of the authority that the petitioner had stayed at Basti for more than 12 years, his transfer has been cancelled.
This Court finds no error in the order, cancelling the order of transfer of petitioner, in the facts and circumstances, noticed above. In case petitioner was at Basti for a period of more than 12 years and had again been transferred to the same position, no exception can be taken, if his transfer is cancelled.
Writ petition fails and is accordingly dismissed.
