JUDGMENT / ORDER

Petitioners apprehend arrest by the Pathanamthitta Police in Crime No.505 of 2014 registered for offences punishable under Sections 143, 147, 148, 341, 323, 324, 308 read with Section 149 of the Indian Penal Code and have filed the application. 2. The learned Public Prosecutor, while opposing the application submits that petitioners 1 and 2 are not so far identified as accused in the case. Petitioners 3 to 5 are accused Nos.3, 1 and 2, respectively. On 21.03.2014 at about 3.30 p.m. petitioner 3 to 5 and other accused formed unlawful assembly and attacked the de facto complainant who is a student of the Pathanamthitta Catholicate College for the reason that he informed the Principle of that college that the accused had come to the college from outside and created trouble. The 4th petitioner used a stick while the 5th accused used a stone. The 3rd petitioner wrongfully restrained the de facto complainant.

3. Learned counsel submitted that the allegations are not true.
It is also submitted that there is no complaint from the college authorities concerning the alleged incident.
4. Having regard to the relevant circumstances of the case, request for pre-arrest bail cannot be allowed. Petitioners 1 and 2 are to be interrogated. Whether they are involved in the case has also to be identified. Petitioners shall surrender before the officer investigating the case on 26.06.2014 at 10 a.m. and on other dates as directed by the investigating officer in case interrogation is not completed. In case the petitioners are arrested, they shall be produced before the Jurisdictional magistrate as early as possible.
The application is disposed of as above.
