Heard learned counsel for the petitioner and learned counsel for the respondents.
2. This writ petition was filed challenging the action of the respondents in trying to lay a road in petitioner’s land in Survey Nos.135 & 142, Nanakramguda Village, Serilingampally, Ranga Reddy District, without initiating any proceedings under the Land Acquisition Act.
3. The learned counsel for the petitioner subsequently filed a reply affidavit stating that the respondents issued a notification under Section 4 (1) of the Land Acquisition Act on 29.12.2009 which was published in Deccan Chronicle newspaper on 12.01.2010 proposing to acquire Ac.0.25 guntas in Survey No.135 and Ac.0.30 guntas in Survey No.142 of Nanakramguda Village, Shamshabad Mandal, Ranga Reddy District, and it was followed by a notice dated 12.01.2010 issued under Section 5-A of the Land Acquisition Act. In view of the same, the cause of action does not survive.
4. Recording the said statement, the writ petition is dismissed.
Pending miscellaneous petitions, if any, shall stand dismissed in consequence. No costs.
