High Court Of Kerala|11 June, 2014

JUDGMENT / ORDER

Petitioner is accused in Crime No.157 of 2014 of the Badiadka Police station for the offences punishable under Sec.341, 324 and 307 read with Sec.34 of the Indian Penal Code for alleged assault on the defacto complainant on his chest with knife on 17.03.2014 at about 11 a.m., is in custody from 23.05.2014 and seeks bail. 2. Learned Public Prosecutor has opposed the application. It is submitted that the petitioner is involved in several other cases registered by the Kasaragod and Vidyanagar Police for offences including Sec.153A of the IPC. It is submitted that final report is filed in the Judicial First Class Magistrate Court-I, Kasaragod on 31.05.2014.
3. Learned counsel submitted that since the final report is filed, further detention of the petitioner is not required.
Bail Appl. No.3990 of 2014 2
4. On hearing both sides, it appears to me that the alleged incident also has a colour of communalism. The petitioner to his credit several cases registered for the same reason in two other Police stations. Grant of bail at this stage therefore is not warranted for various reasons including interest of the society. But it is made clear that it is open to the petitioner to request for bail after the case is committed to the Sessions Court.
The application is dismissed with the above direction.
