Heard Sri Ranjit Saxena, learned counsel for the petitioner and Sri Vinayak Mithal, learned counsel for the respondent no.1.
The only submission of the learned counsel for the petitioner is that the Case No.1280 of 2015 (Smt. Swati Gupta Vs. Akshay Gupta) filed under Section 9 of the Hindu Marriage Act, 1955 before the Court of Additional Principal Judge, Family Court, Meerut be decided expeditiously.
However, Sri Vinayak Mithal, learned counsel for the respondent points out that a direction to decide the suit within 8 months has already been given by this Court on 11.09.2018 in Writ Petition U/A 227 No.6664 of 2018 ((Swati Gupta Vs. Akshay Gupta) and the period of 8 months have not expired so far. The order of the Court dated 11.09.2018 has been filed as Annexure-3 to the writ petition.
In this view of the matter, this is a frivolous writ petition since there is already an order of the Court for expeditious disposal within 8 months.
The writ petition is accordingly dismissed.
