ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the action of the respondents in not considering the candidature of the petitioner for appointment to the last grade services in place of his mother who died in harness while working as maid-servant in third respondent’s Devasthanam, on compassionate grounds as illegal, arbitrary and discriminatory and in violation of principles of natural justice and law and consequently direct the second and third respondents to appoint the petitioner in place of his mother in third respondent’s Devasthanam.
Heard the learned counsel appearing for the petitioner and the learned Standing Counsel for Endowments appearing for the respondents.
The petitioner’s mother A.Nookarathnam, a last grade service in Sri Veera Venkata Satyanarayana Swamy Devasthanam/third respondent she died while in service leaving behind, the petitioner and married sister Smt.Atchutamba as her legal heirs. It is submitted that the petitioner is the dependant on the earnings of his deceased mother and therefore, he made an application to the respondents to provide him appointment on compassionate grounds. Thereafter, it is said that the officials of the third respondent asked the petitioner to attend the office along with relevant documents. But, in spite of attending the office along with the relevant documents, it is submitted that the case of the petitioner was not considered for appointment on compassionate grounds. It is said that the petitioner submitted representation on 25.12.2010 to the third respondent stating that he is eligible for appointment on compassionate grounds as per rules.
In view of the above and having regard to the facts and circumstances of the case, the respondents are directed to consider and dispose of the representation, dated 26.10.2009 made by the petitioner whereunder he sought for appointment on compassionate grounds, as per rules, within a period of two months from the date of receipt of a copy of this order.
Accordingly, the writ petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, filed in this writ petition shall stand closed.
