JUDGMENT / ORDER

The petitioner has approached the Sub Collector on account of non-acceptance of basic tax. Her application has been rejected as per Ext.P6. It is stated that the third respondent has raised a claim in respect of the property claimed by the petitioner comprised in Re-survey No.14/3 of Wandoor Village. It is seen from the order itself that two persons are claiming this property and they were not able to produce any document to substantiate their claim and therefore, only through the intervention of the court, basic tax can be accepted. The petitioner relies on Ext.P4 possession register and Ext.P5 basic tax register. The petitioner submits that the third respondent’s property is situated in another property and she relies on Ext.P3.
W.P.(C) No.31307 of 2014 2 Considering the documents produced before this Court, I am of the view that an opportunity should be given to the petitioner and the third respondent. Accordingly, Ext.P6 is set aside. The petitioner shall produce Exts.P3 to P5 before the Sub Collector. The Sub Collector shall take appropriate decision after affording an opportunity of hearing to the petitioner and the third respondent within a period of two months.
The writ petition is disposed of as above.
