Heard learned counsel for the applicant, Sri Vikas Sahai, the learned A.G.A. for the State and perused the record.
The instant application has been moved seeking anticipatory bail in Case Crime No.346 of 2020, under Section 3(1) U.P. Gangsters and Anti Social Activities (Prevention) Act, Police station Bajariya, District Kanpur Nagar.
Section 438 Cr.P.C. as applicable in the State of U.P. bars the remedy of anticipatory bail where the provisions of the U.P. Gangsters and Anti-Social Activities (Prevention) Act are invoked.
It is accordingly dismissed as not maintainable.
