Heard learned counsel for the applicant, Shri R.P. Dwivedi, learned counsel for the complainant and learned AGA for the State.
Perusal of record shows that anticipatory bail application has already been rejected by this Court previously and he was granted time to surrender before the trial court.
Learned AGA submitted that after that applicant moved petition under Section 482 Cr.P.C. for challenging the charge sheet. This petition was also rejected by this Court. But this fact is concealed while filing the present application for anticipatory bail.
The conduct of applicant shows that he is playing by trick with High Court and Judicial System. Now learned counsel for the applicant has prayed to withdraw this anticipatory bail application.
The learned counsel for the applicant is permitted to withdraw this anticipatory bail application and cost of Rs.5,000/- is imposed on him, which shall be deposited in High Court Legal Services Committee at Allahabad within a period of 15 days from today.
Accordingly, the anticipatory bail application is dismissed as withdrawn.
