Heard learned counsel for the petitioners, Mrs. Ekta Kaur, counsel for respondent no. 3 and learned AGA.
Learned counsel for the petitioner submitted that marriage of the petitioners was an arrange marriage, which was solemnized on 9.5.2015. It is argued that petitioner no. 2, corpus was taken away by her father and since then she is being illegally detained at her parental home.
Pursuant to order of the Court, respondent no. 3 has produced the petitioner no. 2, corpus, Smt. Kusum before the Court, who has been duly identified by counsel for respondent no. 3.
On being questioned, the corpus has stated that she is aged about 32 years, she does not deny the marriage with petitioner no. 2, however, she states that soon after the marriage she was subjected to cruelty for demand of dowry and ultimately she was turn out from her matrimonial home and at present she is living with her parents; she has stated that she wants to go with her parents and not with petitioner no. 1.
In view of the statement made by the corpus, the instant writ petition is dismissed. Registrar General of this Court is directed that the amount of Rs. 15,000/- deposited by the petitioner no. 1 shall be paid to petitioner no. 2, corpus Smt. Kusum Chandra through demand draft after due verification.
