By means of the present petition, the petitioner herein seeks for quashing of the First Information Report dated 23.07.2021 registered as Case Crime No.0185 of 2021 under Sections 506 I.P.C. & 67 Information Technology (Amendment) Act, 2008 P.S-Mehdawal District-Sant Kabir Nagar.
The contention of the learned counsel for the petitioner is that the allegations in the first information report are false and have been made in retaliation to the demand raised by the petitioner regarding some personal loan extended to deceased father of the complainant.
The statement in the first information report regarding commission of offence are clear and categorical. It cannot be said that it does not disclose the commission of cognizable offence.
The contention of the learned counsel regarding merit of the allegations cannot be seen within the scope of Article 226 of the Constitution of India.
The writ petition is thus found devoid of merit and hence dismissed.
