This Petition coming on for Preliminary Hearing this day, the Court delivered the following:-
ORDER Learned counsel for the petitioner submits, and the learned Sr. Panel counsel for the respondent-University does not dispute, that the subject matter of this writ petition is substantially similar to the one in cognate W.P. Nos.48194-48198/2018 & connected matters disposed off by this Court vide Judgment dated 21.12.2018, and therefore, the similar relief needs to be granted to the petitioner herein on the principle of parity.
2. In view of the above, this writ petition succeeds in part; a Writ of Mandamus issues directing the respondents to submit the answer scripts of the petitioner pertaining to Dravyaguna Vignana (Paper-I and Paper-II) for the third evaluation within, a period of two weeks, if percentage difference between the two evaluations is found to be not less than 15% in terms of 2012 Ordinance as interpreted by this Court vide para 25 of the aforesaid judgment.
No costs.
