Heard Sri Vibhu Rai, learned counsel for the petitioner, Sri Vikas Budhwar, learned counsel for the respondent-corporation and perused the record.
By means of this writ petition under article 226 of the constitution, the petitioner has assailed the order impugned dated 30th of November, 2019 whereby the candidature of the petitioner has been rejected on the ground that the caste certificate submitted by the petitioner was of a later date than the application when it was filed before the corporation pursuant to the advertisement dated 25.11.2018.
At the very outset, learned counsel appearing for the respondent- corporation submits that the petitioner has an alternative remedy to approach the competent authority of the corporation vide clause-18 of the brochure/guidelines framed for the said purpose. Counsel for the respondent has also placed before us the instruction according to which fresh draw of lotts have not taken place even after the cancellation of the candidature of the petitioner.
In view of the above, the writ petition is disposed of with a direction that in case the petitioner applies by appropriate complaint in terms of the provisions as contained in Clause-18 of the brochure along with the requisite fee within four weeks from today, the same shall be looked into by respondent Corporation and appropriate orders shall be passed on such complaint within a further period of six weeks. Needless to add the order will be reasoned and speaking one.
