Heard learned counsel for the parties.
By means of this contempt application filed under section 12 of the Contempt of Courts Act, 1971 non-compliance of the order of writ Court dated 03.08.2021 passed in Writ- A No.- 8926 of 2021 is complained of.
Sri Mahendra Pratap Singh, learned Standing Counsel submits that he has obtained instruction in the matter in compliance of the order of this Court dated 02.09.2021 and as per the instruction, a decision has been taken by the competent authority in compliance of the order of writ Court dated 03.08.2021 passed in Writ - A No. 8926 of 2021 by passing an order on 17.09.2021.
Copy of the instruction is supplied to learned counsel for the applicant in the Court itself and the same is also placed on record.
In the considered opinion of this Court, since the writ Court had issued a direction to decide the application of the applicant and the said application has come to be decided by the competent authority by passing an order in writing, the order of writ Court has stood complied with in its letter and spirit.
In view of the above, the there remains nothing for the applicant to continue this contempt application.
Contempt application is accordingly consigned to record. Notices issued, if any, stand discharged.
It is open for the applicant to seek such remedy, as may be available in law, if he is still aggrieved.
