Heard Sri Deo Prakash Singh, learned counsel for the petitioner, learned AGA for the respondents-State and perused the record.
This petition for writ under Article 226 of Constitution of India is preferred to have direction for respondent no. 3 to ensure fair and expeditious investigation in Case Crime No. 652 of 2017 pending investigation at Police Station Mohammadabad, District Ghazipur pertaining to offence punishable under Section 304 IPC.
The petitioner before approaching this Court submitted a representation to the Superintendent of Police, Ghazipur for expeditious investigation in the matter.
From perusal of the documents annexed with the writ petition, it reveals that the first information report was lodged in the month of September, 2017 and the same requires expeditious investigation and also filing of a police report before the Court competent is required.
Having considered all facts of the case, we deem it appropriate to dispose of this petition for writ by directing respondent no. 2 - Superintendent of Police, Ghazipur to ensure expeditious investigation in the matter and further filing of a police report as per provisions of Section 173 Cr.P.C. before the Court competent. It shall be the responsibility of the petitioner to present a certified copy of this order before the Superintendent of Police, Ghazipur within a period of 15 days from today.
With the directions as above, this petition for writ stands disposed of.
