Heard Sri Krishnaji Khare, learned counsel for the petitioner. Sri Sabhajeet has appeared on behalf of Union of India, respondent No.1.
The petitioner was appointed as Technical Assistant in the Micro Small and Medium Enterprises Technology Development Centre i.e. Centre for the Development of Glass Industry.
The Ministry has issued an advertisement No.CDGI/503/ADVT/2017/01 inviting applications for the posts of Glass Technologist and Assistant Glass Technologist. The advertisement apart from other qualifications prescribes the maximum age as on 1.6.2017 to be 40 years and 35 years respectively for the posts of Glass Technologist and Assistant Glass Technologist. It is further provides age relaxation of five years for the internal candidates.
The contention of learned counsel for the petitioner is that the since the petitioner is an internal candidate and there is no promotional avenue the department should provide further age relaxation so that the petitioner may apply.
Learned counsel at this stage requests that he may be permitted to withdraw the petition with liberty to file fresh as he has not made a prayer for challenging the conditions of advertisement.
In view of the aforesaid statement the petition is dismissed as withdrawn with liberty to file fresh, if necessary.
