JUDGMENT / ORDER

1. Heard Mr. Clerk, learned Advocate for the petitioner. Applicant has brought under challenge order dated 15.07.2011 (pages 49 to 52) and also order dated 25.01.2012 passed in Appeal (ICN) No.2 of 2011 whereby the appeal is rejected and the order of the First Authority is confirmed.
2. Mr.
Clerk submitted that there are two separate unions in the same local area and in view of the impugned orders, one of the two unions is treated and considered as Approved Union, while the other union is conferred the status of Representative Union. He submitted that such position being contrary to the provisions of the Bombay Industrial Relations Act, 1946 the impugned orders deserve to be set aside.
3. I have considered the submissions. Upon examining and considering the impugned orders, it appears necessary to hear the concerned other union and the Registrar under the BIR Act. Hence, Notice returnable on 2nd March 2012.
4. Notice as to interim relief as well. Direct service is permitted.
