Heard learned counsel for the petitioner and Sri Baleshwar Chaturvedi, learned counsel for the respondent nos. 2, 3 and 4.
The petitioner is seeking to challenge the transfer order on the ground that his family is residing at Kanpur Dehat and being a Class-III employee as per the transfer policy, he ought to have been transferred in the nearby district.
Further the petitioner's teenaged daughter is studying in Kanpur Dehat.
With this submission, the petitioner seeks modification of the transfer order passed on 4.7.2019.
Learned counsel for the respondents, on the other hand, submits that the petitioner has yet not joined the place of transfer.
In view of the same, it is directed that the petitioner shall first join the place of transfer with a period of ten days.
In the event, the petitioner submits his joining at the transferred place, it would be open for him to make a representation before respondent no. 3 raising all his grievances within a period of two weeks.
In the event, the petitioner files the representation, the respondent no. 3 namely the Chief Engineer, Kanpur Circle, Dakshinanchal Vidyut Vitran Nigam Ltd, Kanpur shall consider the same by passing a reasoned and speaking order in accordance with law within a period of four weeks, thereafter.
